The aim of this study is to identify the legal instruments adopted in France and Spain to promote sustainability in the wine sector, analysing how and whether this principle is safeguarded in both legal systems. The study adopts a comparative approach based on an analysis of legislative, case law, and doctrinal sources. It has highlighted, in the evolution of wine-related regulations within both legal systems analysed, a gradual legalization of sustainability standards through the synergistic collaboration between public and private actors.
