The paper aims to highlight the contemporary relevance of certain passages contained in Aristotle’s Rhetoric within a judicial context that is increasingly oriented toward digitalization. Starting from a passage in a judicial decision issued by the Regional Administrative Court of Lazio (T.A.R. Lazio), the analysis will focus on the relationship between desire, linguisticity, and reason in the Aristotelian thought. Subsequently, similarities with the philosophy of J.R. Searle will be examined, particularly with regard to the relationship between desire and belief. Finally, the notion of “ethos” within the rhetorical framework will be investigated in order to understand how the considerations expressed by the T.A.R. Lazio may find theoretical support.

Abstract
