The article addresses the issue of regional spending autonomy in the light of the failure to implement art. 119 of the Constitution after the enter into force of l. cost. n. 1 of 2001; taking into account the effects produced by the 2012 constitutional reform of articles 81, 97 and 119 Cost. and placing it in the context of the European integration process. The reform process of the founding treaties of the Union (the entry info force of the Lisbon Treaty) is carefully taken into exam in order to review the thesis that the compression of the regional financial autonomy is mainly a “natural” effect of primary and secondary EU law. In this context, the jurisprudence of the Constitutional Court is also taken into account, and it shows how (in some decisions, expecially those concerning financial regulation of EU funds) it is through the principle of reasonableness that it could be possibile to ensure, at the same time, guarantee of autonomy and “allocative” efficiency of resources. It i salso taken into account the effects of the new budget conditionalities on the rule of law to assess whether there is further space for regional financial autonomy, also beyond the implementation of the National Plan for Recovery and Resilience (PNRR).

Il nodo dell’autonomia di spesa Regionale viene affrontato alla luce della mancata attuazione dell’art. 119 Cost., degli effetti prodotti dalla riforma costituzionale del 2012 e collocandolo nel contesto del processo d’integrazione europea. È fortemente valorizzato, a quest’ultimo riguardo, il processo di riforma dei trattati istitutivi dell’Unione al fine di sottoporre a una attenta verifica la tesi per cui la compressione dell’autonomia finanziaria regionale sia quasi un effetto “necessitato” dallo stesso impianto del diritto dell’Unione, primario e derivato. Si prende a tal fine in esame anche la giurisprudenza della Corte costituzionale rilevando come in alcune decisioni (rese in relazione alla disciplina interna di attuazione ai fondi strutturali UE) attraverso il controllo di ragionevolezza sia stato possibile assicurare al contempo, garanzia dell’autonomia ed efficienza “allocativa” delle risorse. Si giunge quindi ad esaminare gli effetti delle nuove condizionalità di bilancio sullo stato di diritto, oltre l’attuazione del Piano nazionale di ripresa e resilienza (PNRR) per valutare se sussistono spazi ulteriori per l’Autonomia finanziaria regionale.
