The author of this article peruses the European legislation in order to find out which limits it is possible to bring, before the same court, actions concerning matrimonial matters and related claims, such as maintenance obligations and parental responsibility. In the first part, the article illustrates EC regulation n.2201/2003, so called Brussels II bis, regarding jurisdiction in civil matters relating to divorce, legal separation or marriage annulment. Thereafter, the article reviews European legislation on jurisdiction in matters concerning maintenance obligations and parental responsibility so as to compare the different provisions. The article provides a framework to determine within which limits it is allowed to bring, before the same court, matrimonial matters and related claims. The purpose of this article is to overcome the fragmentation of the European provisions on jurisdiction, in order to find out if it is possible to bring the different claims before the same court; in this way it could be possible for the parties to avoid several proceedings and obtain effective access to justice.
L’articolo esamina entro quali limiti è consentito cumulare davanti allo stesso giudice le cause in materia di matrimoniale e le domande connesse e, in particolare, le domande relative al pagamento del mantenimento e all’affidamento dei figli. Nella prima parte, l’Autore esamina le disposizioni sulla competenza giurisdizionale nelle cause tra coniugi in materia di divorzio, separazione personale e annullamento del matrimonio, contenute nel regolamento n. 2201 del 2003, c.d. Bruxelles II bis. Nella seconda parte dell’articolo, l’Autore illustra le norme sulla competenza giurisdizionale nelle cause in materia di obbligazioni alimentari e di responsabilità genitoriale e procede ad un esame comparativo delle diverse disposizioni. In questo modo l’A. individua in quali limiti la normativa europea consente di proporre davanti allo stesso giudice le diverse domande. Lo studio mira a superare la frammentazione delle norme europee in materia di giurisdizione e a stabilire in quali ipotesi le parti possono cumulare le diverse domande davanti allo stesso giudice, in modo da ottenere un effettivo accesso alla giustizia.
