The twelfth and final transitional provision of the Constitution prohibits any form of reorganization «of the dissolved fascist party». The guarantee provided by this provision is linear in the sense that the Constitution recognizes, in the perpetuation of the fascist conception, a threat to the republic and democracy. Nevertheless, the fact that, from an historical point of view, fascism can be considered a phenomenon of the past, does not prevent the legal scope of the provision from continuing to have its own value for the future, in the event that such movements should recur. The constitutional policy has devalued and reduced the exceptional scope of this self-defense. A regressive process, the latter, which has also affected the doctrine and jurisprudence. The neo-fascism is no longer perceived as a threat to democracy, as anti-fascism has ceased to be a value and a basis of the constitutional pact . The essay, based on data drawn from the Italian reality, but framed in the broader European context, aims to overturn the terms of the issue.

La XII disposizione transitoria e finale della Costituzione sancisce il divieto di riorganizzazione in qualsiasi forma «del disciolto partito fascista». La garanzia costituita da questa disposizione appare lineare, nel senso che la Costituzione riconosce nel perpetuarsi della concezione fascista una minaccia per la repubblica e la democrazia. Nondimeno, la circostanza che dal punto di vista storico il fascismo possa essere considerato oggi un fenomeno del passato, non impedisce che la portata giuridica della disposizione possa continuare ad avere una sua valenza anche per il futuro, nel caso in cui movimenti di questo tipo dovessero ripresentarsi. La politica costituzionale ha provveduto sostanzialmente a svalutare e ridurre la portata eccezionale di tale autotutela. Un processo involutivo, quest’ultimo, che ha interessato anche dottrina e giurisprudenza. Il neofascismo non è più avvertito come un pericolo per la democrazia in quanto è venuto meno l’antifascismo come valore e base del patto costituzionale. Il saggio, sulla scorta di dati tratti dalla realtà italiana, ma inquadrati nel più generale contesto europeo, ha lo scopo di ribaltare i termini della questione.
