Introduzione

The introduction frames the contemporary debate on collective domains (rural commons) in light of the innovations introduced by Italian Law 168/2017 and the activities of the PRIN 2022 project RuComItaly – Valorising Rural Commons for a Greener and Fairer Society. Insights from Southern and Northern Italy. After outlining the project's objectives and the process that led to the volume's preparation, the contribution critically presents its chapters and identifies several cross-cutting themes emerging from their comparison. In particular, local communities are understood not as pre-existing and stable entities, but as historical and relational formations continuously produced through social practices, institutions, and forms of self-government. Similarly, commons are interpreted not merely as forms of ownership or patrimonial arrangements, but as social relations shaped by interactions among resources, communities, rules, and shared responsibilities. The contribution also examines the relationship between local communities and biodiversity conservation, questioning approaches based exclusively on external regulation and highlighting the role of territorial practices, local knowledge, and collective institutions. Particular attention is devoted to the recognition of collective domains as primary legal orders ('ordinamenti giuridici primari') and to the implications of this principle for institutional pluralism, autonomous rule-making, and community participation in territorial governance. The analysis ultimately shifts from the issue of protection to that of governability: legal recognition is a necessary but insufficient condition. It needs to be complemented by operational tools, skills, collaborative networks, and learning processes that make community autonomy effective and strengthen communities’ contribution to the sustainable governance of territories.

L’introduzione inquadra il dibattito contemporaneo sui domini collettivi a partire dalle innovazioni introdotte dalla Legge 168/2017 e dalle attività del progetto PRIN 2022 RuComItaly – Valorising Rural Commons for a Greener and Fairer Society. Insights from Southern and Northern Italy. Dopo aver ricostruito gli obiettivi del progetto e il percorso che ha condotto alla realizzazione del volume, il contributo ne presenta criticamente i saggi e individua alcuni temi trasversali che emergono dal loro confronto. In particolare, viene proposta una lettura della comunità locale non come realtà preesistente e stabile, bensì come formazione storica e relazionale continuamente prodotta attraverso pratiche sociali, istituzioni e forme di autogoverno. Analogamente, i commons vengono interpretati non soltanto come forme proprietarie o patrimoniali, ma come relazioni sociali fondate sull’interazione tra risorse, comunità, regole e responsabilità condivise. Il contributo analizza inoltre il rapporto tra le comunità locali e la conservazione della biodiversità, mettendo in discussione i modelli di tutela esclusivamente fondati sulla regolazione esterna e valorizzando il ruolo delle pratiche territoriali, delle conoscenze locali e delle istituzioni collettive. Particolare attenzione è dedicata al riconoscimento dei domini collettivi come ordinamenti giuridici primari e alle implicazioni di tale principio in termini di pluralismo istituzionale, di capacità autonormativa e di partecipazione delle comunità al governo del territorio. L’analisi conduce infine dal tema della tutela a quello della governabilità: il riconoscimento giuridico rappresenta una condizione necessaria ma non sufficiente, che deve essere accompagnata da strumenti operativi, competenze, reti di collaborazione e processi di apprendimento capaci di rendere effettiva l’autonomia delle comunità e il loro contributo alla gestione sostenibile del territorio.
