The article examines the evolution of the regulatory framework governing public contracts, as well as the prospects for establishing a special regime for projects financed with European funds. Its aim is to offer a comprehensive reading of recent reforms, highlighting the tension between the need for faster procedures and the preservation of procedural safeguards, and identifying possible solutions to make a model that balances efficiency, transparency, and the legality of administrative action. In particular, it analyzes the temporary measures introduced to accelerate and simplify the implementation of works and infrastructure funded through the NRRP and other European resources, taking into account the emergency tools that were first adopted to address the pandemic and later adapted to support economic recovery. The focus then turns to the reform of the Public Contracts Code and the innovations it introduces, starting with the codification of general principles. It also considers the new regulatory framework for strategic infrastructure, while noting that projects financed under the NRRP remain subject to the fragmented system of derogations established by earlier decrees. Finally, the article suggests incorporating and streamlining within the Code the acceleration measures adopted to ensure the effective use of NRRP resources, allowing for the coexistence of two special regimes alongside the ordinary one: one for strategic infrastructure and another for projects financed with European funds.
L’articolo esamina l’evoluzione del quadro normativo che disciplina i contratti pubblici, nonché le prospettive di introduzione di un regime speciale per i progetti finanziati con fondi europei. L’obiettivo è offrire una lettura complessiva delle recenti riforme, evidenziando la tensione tra l’esigenza di accelerare le procedure e quella di preservare le garanzie procedurali, e individuando possibili soluzioni volte a realizzare un modello capace di conciliare efficienza, trasparenza e legalità dell’azione amministrativa. In particolare, l’articolo analizza le misure temporanee introdotte per accelerare e semplificare la realizzazione di opere e infrastrutture finanziate attraverso il PNRR e altre risorse europee, tenendo conto degli strumenti emergenziali adottati inizialmente per fronteggiare la pandemia e successivamente adattati per sostenere la ripresa economica. L’attenzione si concentra quindi sulla riforma del Codice dei contratti pubblici e sulle innovazioni da essa introdotte, a partire dalla codificazione dei principi generali. Viene inoltre esaminato il nuovo quadro normativo relativo alle infrastrutture strategiche, rilevando come i progetti finanziati nell’ambito del PNRR continuino a essere assoggettati al sistema frammentato di deroghe previsto dai precedenti decreti. Infine, l’articolo propone di ricondurre e razionalizzare all’interno del Codice le misure di accelerazione adottate per garantire l’effettivo utilizzo delle risorse del PNRR, consentendo la coesistenza di due regimi speciali accanto a quello ordinario: uno relativo alle infrastrutture strategiche e un altro concernente i progetti finanziati con fondi europei.
