The paper traces the evolution guarantee devices of the judge’s impartiality in Italian criminal proceedings. Drawing on the interplay between the structural and preventive system of intra-procedural incompatibilities and the dynamic ex post facto mechanisms of abstention and recusal, the paper illustrates the phenomenon of the “power of prevention”, highlighting the “thickenings” and transformations of procedural syntax: the “prejudicial” nature of precautionary decisions, as well as the progressive enhancement of the preliminary hearing and the investigative phase in light of the new decision-making parameters introduced by the “Cartabia Reform” (the «reasonable expectation of conviction»), up to the extension of the right to recusal in favor of the person offended by the crime in the archiving procedure.

Abstract
The paper traces the evolution guarantee devices of the judge’s impartiality in Italian criminal proceedings. Drawing on the interplay between the structural and preventive system of intra-procedural incompatibilities and the dynamic ex post facto mechanisms of abstention and recusal, the paper illustrates the phenomenon of the “power of prevention”, highlighting the “thickenings” and transformations of procedural syntax: the “prejudicial” nature of precautionary decisions, as well as the progressive enhancement of the preliminary hearing and the investigative phase in light of the new decision-making parameters introduced by the “Cartabia Reform” (the «reasonable expectation of conviction»), up to the extension of the right to recusal in favor of the person offended by the crime in the archiving procedure.| File | Dimensione | Formato | |
