Abstract
The use of encrypted messaging services such as Ecrochat and SkyEcc by organized crime has posed new challenges in terms of privacy protection and procedural guarantees. The investigations, launched by the French Gendarmerie and culminating in the decryption of thousands of conversations through hacking, have raised sensitive questions about the admissibility and legitimacy of the evidence obtained. This article analyzes the issue, starting with the supranational level, where it examines the guidelines of the European Court of Human Rights and the Court of Justice of the European Union, which, despite reaching different conclusions, show a gradual adaptation of conventional guarantees to digital evidence. Secondly, the analysis focuses on the national level and, in particular, on the rulings of the Supreme Courts of some of the states involved, such as Germany, the Netherlands, Austria, and, most recently, Italy, where the Court of Cassation has adopted an approach that is not fully in line with the respect for defense guarantees.
