The above-mentioned ruling is noteworthy because, in a case concerning the criminal liability of a Nigerian woman—a victim of trafficking for sexual exploitation who was also the perpetrator of a drug-related offense—the court held that the defense of necessity under Article 54 of the Italian Criminal Code could apply, in accordance with the principle established by European law that victims of trafficking should not be prosecuted for offenses they commit. Legal scholarship, in line with the overall international trend, is predominantly in favor of introducing a specific ground for exclusion from punishment—preferably in the form of a excuse—implementing the aforementioned principle of non-criminalization. Among the reasons cited are the need to overcome the rigid limitations on the application of Article 54 of the Italian Criminal Code and the risk of inconsistent interpretations regarding the applicability of the defense. Nevertheless, in countries that have introduced specific grounds for exclusion from punishment, not only does this not appear to have resulted in an effective strengthening of protections for victims of trafficking who are perpetrators of a crime, but there remains a significant lack of predictability in judicial decisions.

Abstract
Nevertheless, in countries that have introduced specific grounds for exclusion from punishment, not only does this not appear to have resulted in an effective strengthening of protections for victims of trafficking who are perpetrators of a crime, but there remains a significant lack of predictability in judicial decisions.| File | Dimensione | Formato | |
