The above-mentioned ruling reaffirms a well-established line of Supreme Court jurisprudence, according to which Article 2 of the Constitution constitutes an insurmountable barrier against the justification of cultural customs, practices, or traditions that give rise to conduct involving oppression, violence, or control, which infringes upon the fundamental rights of the victim. It cannot be ruled out that the judges, based on a more analytical investigation, might have denied the existence of a culturally motivated crime—a criminal offense that applies only when it is established that the conduct was imposed, promoted, or at least authorized by a shared and well-established practice within the perpetrator’s cultural group.
