This article examines the monocratic decree of the President of the CGARS no. 285/2026, which suspended judgment no. 1974/2026 of the Catania Regional Administrative Court confirming the forfeiture of the maritime concession for the “Scialai” beach establishment. The decision is read in continuity with the earlier CGARS decree no. 132/2026 on Mondello beach, highlighting the primacy of periculum in mora, framed as the beach's summer usability, over a fumus boni iuris rendered recessive. Compared with the precedent, the article identifies two more serious features: interim relief here suspends a judgment on the merits, not a mere denial of interim protection; and the factual basis of the forfeiture has already found independent confirmation from the Court of Cassation in criminal proceedings. The article also flags an aspect absent from the decree's reasoning: the link, raised in the State's defence, between the criminal release of the seized establishment and the forfeiture itself, pointing to an environmental periculum of opposite sign. The measure risks reducing interim relief to a tool for economic stabilisation, rather than a safeguard of substantive legality.
Il contributo esamina il decreto monocratico del Presidente del CGARS n. 285/2026, che ha sospeso la sentenza del TAR Catania n. 1974/2026 di conferma della decadenza della concessione demaniale marittima dello stabilimento balneare “Scialai”. La decisione viene letta in continuità con il precedente decreto CGARS n. 132/2026 su Mondello, evidenziando il primato del periculum in mora, costruito come fruibilità estiva della spiaggia, su un fumus boni iuris reso recessivo. Rispetto al precedente, l’analisi individua due profili di maggiore gravità: la cautela sospende qui una sentenza di merito, non un mero diniego cautelare di primo grado; e il quadro accusatorio della decadenza ha già trovato riscontro indipendente nella Corte di cassazione in sede penale. Il contributo segnala inoltre un profilo estraneo alla motivazione del decreto: il nesso, emerso nelle difese erariali, tra il dissequestro penale dello stabilimento e la decadenza della concessione, che configura un periculum ambientale di segno opposto. Ne risulta un provvedimento che rischia di ridurre la cautela a strumento di stabilizzazione economica, anziché a presidio della legalità sostanziale.
