The article analyzes the legal standing of third parties within prevention proceedings (procedimenti per misure di prevenzione) as governed by the Italian Code of Anti-Mafia Laws. The author identifies specific categories of stakeholders – distinct from the primary defendant whose interests are jeopardized by preventive seizures and subsequent confiscations. By evaluating current procedural safeguards and their practical application, the study reveals a systemic erosion of third-party rights. Furthermore, the author highlights a critical failure in the protection of creditors: even when their claims are legally recognized, significant procedural delays and barriers render their rights effectively unenforceable.
