In this contribution, the Author reflects on the current Italian model of enforcement of criminal sentences, with particular focus on the condition of vulnerable detainees. Taking as its starting point the judgment of the European Court of Human Rights of 27 March 2025, Niort v. Italy, the analysis is situated within a framework marked by structural and long-standing shortcomings of the Italian prison system, which call into question the notion of an “emergency” in the prison context. Through an examination of the specific case – as well as of the relevant Convention case-law – the article aims to highlight how the protection of prisoners affected by particular forms of vulnerability is increasingly constrained by a system progressively oriented toward logics of containment and control. Such an approach risks distancing the enforcement of criminal sentences from its constitutional – and supranational – function, ultimately challenging the State’s ability to ensure the centrality of the person even under conditions of deprivation of personal liberty.
Con il presente contributo l’Autore si interroga sull’attuale modello italiano di esecuzione penale, con un focus particolare sulla condizione dei detenuti vulnerabili. Muovendo dalla sentenza della Corte Edu, 27 marzo 2025, Niort c. Italia, la riflessione si inserisce in un quadro segnato da criticità ormai strutturali del sistema penitenziario che minano il concetto stesso di “emergenza carceraria”. Attraverso l’analisi del caso concreto – e della giurisprudenza convenzionale di riferimento –, il contributo mira a mettere in luce il dato secondo il quale la tutela dei detenuti affetti da particolari fragilità risulta progressivamente compressa da prassi sempre più orientate verso logiche di contenimento e controllo. Tale approccio rischia di allontanare il paradigma dell’esecuzione penale dalla sua funzione costituzionale – e sovranazionale –, ponendo in discussione la capacità dello Stato di garantire la centralità della persona anche nella condizione di privazione della libertà personale.
