Orden de Detención Europea y motivo para la no ejecución y suspensión basado en la salud del interesado: sentencia del Tribunal de Justicia, Gran Sala, de 18 de abril de 2023, asunto C‐ 699/21: E.D.L.

This paper analyses the judgment of the Court of Justice, Grand Chamber, of 18 April 2023 (Case C‐699/21: E.D.L.) concerning a reference for a preliminary ruling from the Corte Costituzionale (Constitutional Court, Italy) in proceedings concerning the execution of a European Arrest Warrant. The judgment in question concerns, in particular, the risk that the health of the requested person is manifestly endangered. This commentary addresses the justification for the temporary suspension of the person sought and the circumstances in which the delivery of such person may pose a risk of inhuman or degrading treatment that cannot be excluded within a reasonable period. In the event of the latter situation, the authority responsible for executing the arrest warrant shall not be able to carry out such execution.
