The essay deals with the legal rules on military trade unions in Italy and South Africa: the research highlights that domestic legislators have been recalcitrant to autonomously regulate the phenomena, as they have been “obliged” to comply with judgements of their constitutional courts. Both legal systems differ considerably from the pluralist model of industrial relations enshrined in the national bills of rights: military trade unions are a kind of “craft unions”, because they cannot federate themselves to confederal ones; moreover, they are deprived of the right to strike, partially compensated by arbitration mechanisms; finally, unions can engage in collective bargaining essentially in relation to wages.
