This article critically analyses the institution of “remote internal assignment” of judges, introduced by Decree Law 117/2025 as part of extraordinary measures to achieve the PNRR targets for civil justice. After reconstructing the regulatory framework and statistical indicators (Disposition Time and average duration of proceedings), the article highlights the main critical issues of the system: the subordination of the protection of rights to statistical requirements, the risk of decisions driven by numerical targets, the violation of the principles of public hearings and the pre-appointment of the natural judge, as well as administrative inconsistencies in the CSM guidelines. In conclusion, it is emphasised that the drive to meet PNRR targets has led to a sacrifice in the quality of justice and the effective protection of parties’ rights, with little critical response from the judiciary.

Il contributo analizza criticamente l’istituto dell’applicazione interna “a distanza” dei magistrati, introdotto dal d.l. 117/2025 nell’ambito delle misure straordinarie per il raggiungimento degli obiettivi PNRR sulla giustizia civile. Dopo una ricostruzione del quadro normativo e degli indicatori statistici (Disposition Time e durata media dei processi), l’articolo evidenzia le principali criticità del sistema: la subordinazione della tutela dei diritti alle esigenze statistiche, il rischio di decisioni orientate al conseguimento di obiettivi numerici, la violazione dei principi di pubblicità delle udienze e di precostituzione del giudice naturale, nonché le incongruenze amministrative nelle linee guida del CSM. In conclusione, si sottolinea come la tensione verso il rispetto dei target PNRR abbia portato a sacrificare la qualità della giurisdizione e la tutela effettiva dei diritti delle parti, con una scarsa reazione critica da parte della magistratura.
