This article offers an assessment of Emanuela Calore’s book on the concept of ius Quiritium in Roman law. Ius Quiritium is not a formal tag or a straightforward synonym for civitas Romana, but expresses the foundation of the Roman idea of belonging. Calore shows that ius Quiritium legitimises the meum esse asserted by the pater familias and reflects the community’s recognition of his authority. The study traces the development of ius Quiritium from its earliest ritual uses to its later juristic elaboration. Special attention is devoted to the duplex dominium and to the status of the Latini Iuniani. Calore distinguishes ius Quiritium from both ius civile and ius proprium civium Romanorum, showing that the terms are related but not equivalent. It is only in the Justinianic compilations that ius Quiritium loses its original meaning and becomes assimilated to ius civile. The book provides a sophisticated reading of Roman private law and elucidates the structural connection between property, authority, and civic identity.
Il contributo analizza il libro di Emanuela Calore sul concetto di ius Quiritium nel diritto romano. Il ius Quiritium non è né un’etichetta formale né un semplice sinonimo di civitas Romana, ma esprime il fondamento dell’idea romana di appartenenza. Calore mostra che il ius Quiritium legittima il meum esse affermato dal pater familias e riflette il riconoscimento della sua autorità da parte della comunità. L’indagine ricostruisce lo sviluppo del ius Quiritium dai suoi primi impieghi rituali fino all’elaborazione giuridica successiva. Particolare attenzione è dedicata al duplex dominium e allo status dei Latini Iuniani. Calore distingue il ius Quiritium dal ius civile e dal ius proprium civium Romanorum, mostrando che i termini sono sì collegati, ma non equivalenti. Solamente nella compilazione giustinianea il ius Quiritium perde il suo significato originario e viene assimilato al ius civile. Il volume offre una lettura raffinata del diritto privato romano e chiarisce le connessioni strutturali fra proprietà, autorità e identità civica.
