Indebita percezione di benefici previdenziali e il problema dei reati a consumazione prolungata

This paper examines the issue of whether a single offence or multiple offences linked by the principle of continuation applies in cases of the periodic fraudulent receipt of social security benefits. In line with a recent judgment of the Joint Divisions of the Court of Cassation (No. 11969 of 2024-25), the author considers that a distinction must be made between cases where repeated acts stem from an initial unifying conduct and those where they are independent: indeed, in the former case there is a single “prolonged consummation” offence, whilst in the latter there are multiple offences, as the unifying element of “simultaneity” (a point specifically examined by the author) is absent.

Viene qui analizzato il problema della sussistenza di un unico reato o di più reati uniti dal vincolo della continuazione, nel caso d’indebita percezione periodica di benefici previdenziali. In linea con una recente sentenza delle Sezioni Unite della Cassazione (n. 11969 del 2024-25), l’autore ritiene che occorre distinguere le ipotesi in cui le condotte reiterate dipendono da un comportamento iniziale unificante, dai casi in cui invece esse sono autonome: infatti, nel primo caso c’è un unico reato “a consumazione prolungata”, mentre nel secondo si presentano più reati in quanto manca l’elemento della “contestualità”, che viene specificamente esaminato dall’autore.
