Danilo Dolci is famous for acting non-violent civil disobedience. We ask: did he simply evade specific norms of the legal system in the name of a higher justice, or did he also advance a critique of law as a social device? This article argues that Dolci developed a critical theory of law and the state, albeit unsystematic one. Such reflection is part of a broader analysis of reality and its lines of forces, which he sought to rethink with the outcasts of contemporaneity. From his early investigations, his essays, and his poetry, throughout his long political-educational practice, emerges the intention to overcome the domination-based structure that informs state-based law, even in its most ethically advanced forms. The proposed alternative is a "popular co-organism" that responds to the structure of reciprocal maieutic approach. In conclusion, some experiments in applied legal critics, inspired by Dolci's work, are briefly reported as attempts to reactualise his legacy.
Danilo Dolci è celebre per aver praticato la disobbedienza civile non violenta. Ma si è semplicemente sottratto ad alcune norme dell’ordinamento giuridico in nome di una giustizia più alta, o ha anche avanzato una critica al diritto come dispositivo sociale? La tesi che si propone in questo scritto è che Dolci abbia maturato una teoria critica del diritto e dello Stato, sebbene non sistematica. Tale riflessione costituisce un tassello all’interno di una più ampia analisi della realtà e delle sue linee di forza che con i paria del tempo intendeva ripensare. Dalle sue prime inchieste, nei lavori saggistici e di poesia, nel corso della sua lunga pratica politico-educativa emerge il proposito di superare la struttura improntata al dominio che informerebbe il diritto di matrice statale pur nelle sue forme eticamente più avanzate. L’alternativa proposta è un «coorganismo popolare» che risponda alla struttura della maieutica reciproca. In conclusione, vengono brevemente riportati alcuni esperimenti di critica del diritto applicata, ispirati all’opera di Dolci come tentativi di riattualizzazione della sua eredità.
