This paper aims to analyze the main legal challenges posed using artificial intelligence, with reference to the constitutional implications and European regulation of the phenomenon. This study aims to understand whether and to what extent the current regulatory framework is suitable, on the one hand, to govern the impact of artificial intelligence, preventing technological development from undermining democratic rights and guarantees, and, on the other, to promote technological innovation in Europe.
