Decision No. 448/2025 of the Council of Administrative Justice for the Region of Sicily (Cons. Giust. amm. Sicilia) revisits the judicial review of anti-mafia information (informazioni antimafia), further endorsing the line of case law that recognizes, in this field, a full and effective right of access to the facts underpinning the prefectural measure. The Sicilian court also affirms the full compatibility between the criminal court’s review at the interim (precautionary) stage and the probabilistic assessments on which the administrative decision must rest, together with the ensuing judicial scrutiny thereof. The judgment thus offers grounds for reflection on the breadth of the administrative judge’s cognizance (scope of review), particularly with respect to the characterization of factual elements capable of constituting an attempted mafia infiltration into an economic activity
