This contribution examines the evolution of the concept of fair compensation for private reproduction under Directive 2001/29/EC (the InfoSoc Directive) and explores whether copyright and neighbouring rights holders may directly invoke Article 5(2)(a) and (b) of the Directive in order to challenge national mechanisms for the collection of such compensation, in light of the judgment in Reprobel. The analysis further considers the potential extension, by analogy, of the fair compensation regime to digital service providers that facilitate access to protected works.
