Diritto privato e potere: le situazioni potestative tra Otto e Novecento

The article examines the relationship between private law and power, focusing on the theoretical issues addressed by civil law scholarship between the nineteenth and twentieth centuries. Building on Santi Romano’s reflections on the interpenetration of public and private spheres, the study traces the emergence of «Gestaltungsrechte» in Germany and «diritti potestativi» in Italy. Throughout the twentieth century, the debate on formative rights provided theoretical and ethical responses, while the role attributed to the judge revealed divergent conceptions, also reflecting the strategies and ideologies of totalitarian regimes.

L’articolo s’interroga sul rapporto tra diritto privato e potere, soffermandosi sui nodi teorici affrontati dalla cultura civilistica tra Otto e Novecento. Sulla scia della riflessione di Santi Romano, che mette a fuoco la compenetrazione tra pubblico e privato, l’indagine ricostruisce le tappe che scandiscono la nascita dei «Gestaltungsrechte» in Germania e dei «diritti potestativi» in Italia. Nel corso del Novecento il dibattito sulle situazioni potestative fornisce risposte teoriche ed etiche, mentre il ruolo attribuito al giudice rivela concezioni diverse, anche in relazione alle strategie e alle ideologie dei totalitarismi.
