This paper aims to study the impact of artificial intelligence on creditworthi- ness assessment and, in particular, on the assignment of credit scores to ap- plicants, in light of the applicable legislation in European Union countries. It highlights how, in the current regulatory system, as a result not only of the more specific credit regulations but also of the more general European regulations on the processing of personal data (GDPR) and artificial intelligence (AI Regula- tion), there is little scope for the use of so-called soft data for creditworthiness assessment and probably no scope for artificial intelligence systems based on so-called black boxes. It concludes by noting that the problems raised by the legal regulation of artificial intelligence are reminiscent of those raised at the dawn of this century by the advent of the Internet, giving rise to a conflict of values and ideologies that is in many ways similar.
