This paper systematically analyses the complex system of legal sources governing proceedings before the Financial Banking Arbitrator (ABF), highlighting the stratification between supranational sources, national primary and secondary legislation, and internal regulations of the Bank of Italy. The nature of the ABF is examined, qualifying it as an ADR body with a decisional but non-binding character, and the “persuasive” value of its decisions is discussed. The article also explores the applicability of civil procedural principles to ABF proceedings, with particular attention to adversarial process, the right of defence, and the burden of proof, emphasising the peculiarities and limits of the procedure compared to judicial proceedings. In conclusion, it is highlighted that ABF decisions, although pronounced according to the law, may differ from any judicial decisions rendered subsequently or as an alternative to the ADR remedy.
Il contributo analizza in modo sistematico il complesso sistema delle fonti normative che regolano il procedimento davanti all’Arbitro Bancario Finanziario (ABF), evidenziando la stratificazione tra fonti sovranazionali, nazionali primarie e secondarie, e regolamenti interni della Banca d’Italia. Viene approfondita la natura dell’ABF, qualificata come organismo ADR a carattere decisorio ma non vincolante, e il valore “latamente prognostico” delle sue pronunce. L’articolo esamina inoltre l’applicabilità dei principi del processo civile al rito ABF, con particolare attenzione al contraddittorio, al diritto alla difesa e all’onere della prova, sottolineando le peculiarità e i limiti del procedimento rispetto al processo giurisdizionale. In conclusione, si evidenzia come le decisioni dell’ABF, pur essendo pronunziate secondo diritto, possano discostarsi dalle eventuali decisioni giudiziarie, rese "a valle" o in alternativa al rimedio ADR.
