L’interesse legittimo come situazione giuridica soggettiva protetta : un focus storico

Legitimate interest, situated within the framework of general le- gal theory, possesses its own axiomatic autonomy as a substantive legal situation allowing its holder to relate with public power, exercising fa- culties capable of influencing the exercise of power and the choices of me- rit. The author examines the nature of legitimate interest, retracing the evolutionary stages that have characterized the subject in question, ul- timately qualifying it as a legally protected subjective situation in the Italian legal system. The investigation is carried out through frequent comparisons and references to foreign and national legislations in or- der to better understand, also from a comparative perspective, the choice ultimately adopted by the Italian legal system.
