This essay explores the concept of lawyer fidelity, transcending its traditional association with personal morality and anchoring it in the notion of the rule of law. The complexity of the principle of fidelity is highlighted, with reference to both the client's interests and the constitutional and social significance of the right to defense. The author believes that lawyer loyalty should be interpreted as a responsibility inherent to the legal profession within a legal and social system founded on the rule of law. In this context, the rule of law is not limited to the traditional rule of law, but extends to all forms of law, public and private, as a universal principle against arbitrariness, in favor of equality and dignity. Fidelity, therefore, emerges as a thoughtful and creative commitment, requiring lawyers to actively contribute to the construction and maintenance of a fair social order, protecting fundamental rights and freedoms.
Il saggio esplora il concetto di fedeltà dell’avvocato, superando la tradizionale associazione con la morale personale per ancorarlo alla nozione di rule of law. Viene evidenziata la complessità del principio di fedeltà, con riferimento sia all’interesse del cliente sia al rilievo costituzionale e sociale del diritto alla difesa. L’autrice ritiene che la fedeltà dell’avvocato debba essere interpretata come una responsabilità collegata alla funzione forense nell’ambito di un sistema giuridico e sociale fondato sulla rule of law. In questo contesto, la rule of law non si limita allo stato di diritto tradizionale, ma si estende a tutte le forme di diritto, pubbliche e private, come principio universale contro l’arbitrio, a favore dell’eguaglianza e della dignità. La fedeltà, dunque, si configura come un impegno riflessivo e creativo, che richiede all’avvocato di contribuire attivamente alla costruzione e al mantenimento di un ordine sociale equo, tutelando i diritti e le libertà fondamentali
