L'erroneo ricorso al doppio ciclo causale

A recent pronouncement of the Court of Varese offers the opportunity for a brief discussion on the sub-ject of causation, in order to assess whether, to date, the distinction, now established in jurisprudence and in part of doctrine, can still be said to be current and viable, on the distinction between “material causality” and “juridical causality,” intended, the former as the causal link between conduct and the harmful event and the latter as the link between the conduct (ascertained as unjust and for that reason harmful) and the damages suffered by the injured party, offended by the tort.

Un recente pronunciamento del Tribunale di Varese offre l’opportunità di un breve approfondimento in tema di nesso di causalità, al fine di valutare se, a tutt’oggi, possa dirsi ancora attuale e percorribile la distinzione, ormai invalsa in giurisprudenza e in parte della dottrina, sulla distinzione tra “causalità materia-le” e “causalità giuridica”, intesa, la prima quale legame causale tra condotta ed evento lesivo e la seconda come legame tra la condotta (accertata come ingiusta e per tale ragione dannosa) e i danni patiti dal danneggiato, offeso dall’illecito.
