The paper deals with the posting of workers as an issue marked by a strong conflict between economic freedoms and social rights in the European Union’s approach. Taking into account the 2018 Directive and recent case law of the Court of Justice, the paper aims to show a change of course in the European approach to this issue towards more social objectives as part of a broader new social spirit of the European Union.

Abstract
