This article analyses the changes introduced by Legislative Decree 209/2024 (the so-called corrective) to the social clauses regulated by the Public Procurement Code, Legislative Decree 36/2023. The article focuses, firstly, on the innovations introduced by the new Annex I.01, which regu-lates both the criteria for identifying the collective agreements to be ap-plied in public contracts and concessions and the parameters for assessing the "equivalence" of the other contract that the economic operator wishes to apply. Secondly, it looks at the innovations in the protection of subcon-tracted workers. Finally, the article proposes an analysis of the new obliga-tions imposed on economic operators to promote the equal employment of women and young people and the employment of disadvantaged persons (so-called third-generation clauses), also taking into account their interac-tion with the measures to protect employment stability in the event of a change of contract (so-called second-generation clauses).
Il presente contributo analizza le novità apportate dal d.lgs. 209/2024 (c.d. correttivo) alle clausole sociali disciplinate dal Codice dei Contratti Pubblici, il d.lgs. 36/2023. Il contributo si sofferma, in primo luogo, sulle novità introdotte dal nuovo All. I.01, che disciplina sia i criteri di indivi-duazione dei contratti collettivi da applicare negli appalti e nelle conces-sioni pubbliche sia i parametri di valutazione dell’«equivalenza» del diver-so contratto che l’operatore economico voglia applicare. In secondo luogo, sono affrontate le novità relative alla tutela dei lavoratori in subappalto. Infine, il contributo propone un’analisi dei nuovi obblighi imposti dagli operatori economici volti alla promozione della parità occupazionale di donne e giovani e all’inserimento lavorativo delle persone svantaggiate (cd. clausole di terza generazione), tenendo in considerazione anche la lo-ro interazione con le misure poste a tutela della stabilità occupazionale nelle ipotesi di cambio d’appalto (cd. clausole di seconda generazione).
