Spunti di riflessione sulla legge Regione Siciliana n.15/2022. Norme per la tutela degli animali e la prevenzione del randagismo

This paper analyzes the main innovations introduced by the law of the Si- cilian Region of August 3, 2022 n.15, on the subject of animal welfare and prevention of stray animals, in relation to the modern form of protection of non-humans - sentient beings. - able to convey a plurality of values in the past considered mutually exclusive in the same legal approach. It promotes a constitutionally oriented reading of the regional law in ques- tion, especially with regard to the new formulation of Article 9 of the Con- stitution, which, by virtue of the Constitutional Law 1 February 11, 2022, contains in the third paragraph a reservation of state law regarding the ways and forms of animal protection. Finally, some critical considerations are raised on the real economic-finan- cial possibility / capacity of those legal entities which are primarily entrus- ted with the heavy burden of implementing the new regulations
