Riflessioni a margine di una recente sentenza della Corte di Giustizia: pagamento unico per superficie determinata e mutamento di destinazione del fondo rustico

The article examines a recent judgment of the European Court of Justice dealing with the preliminary question of the area eligible for CAP aid, with reference to the hypothesis of land granted for fish farming subsequently changed into arable land without the consent of the grantor. The case, even if concerns a case of Romanian law, gives the author the opportunity to reason about the applicability of legal reasoning by the ECJ to the Italian legal system, where the circulation of rustic land is almost entirely regulated by Law 3 May 1982, n.203.
