La genesi del Libro VI del codice civile "Della tutela dei diritti" e la questione dell'influenza fascista

The essay deals with the formation of Book VI of the Civil Code, also in the light of the critical material to be found in the “Observations and Proposals on the Protection of Rights Book Project”. Book VI lends itself as a privileged observatory to verify whether there was, and to what extent, an influence of fascist ideology on the 1942 Civil Code. Examination of the archive materials also offers food for thought for a more in-depth evaluation of some of the technical solutions adopted in Book VI, especially with regard to the testimonial proof and the judicial protection of rights.

Il saggio tratta della formazione del Libro VI del Codice Civile, anche alla luce del materiale critico reperibile nel “Progetto di Osservazioni e Proposte sul Libro della Tutela dei Diritti”. Il Libro VI costituisce un osservatorio privilegiato per verificare se e in che misura vi sia stata un'influenza dell'ideologia fascista sul Codice Civile del 1942. L'esame del materiale d'archivio offre inoltre spunti di riflessione per una valutazione più approfondita di alcune delle soluzioni tecniche adottate nel Libro VI, in particolare per quanto riguarda la prova testimoniale e la tutela giurisdizionale dei diritti.
