With the ruling in comment, the Supreme Court draws a definition of abuse of economic dependence on the basis of an analysis of the prerequisites set forth in Article 9, Law No. 192 of 1998, taking into account the concrete conditions of the dependent company and the availability of alternatives on the market, as well as the boundaries between the legitimate exercise of the dominant company's bargaining autonomy and forms of harassment contrary to good faith.
