L'efficacia inter-temporale dell'interpretazione evolutiva dei trattati sui diritti umani

It is commonly accepted that human rights treaties are « living instruments » which must be interpreted in the light of « present-day conditions ». However, it is unclear how this should be reconciled with the principle of inter-temporal law, which provides that an act of a State does not constitute a breach of an international obligation unless the State is bound by the obligation in question at the time the act occurs. To answer this question, this contribution examines how international human rights courts and monitoring bodies establish the intertemporal effects of evolutive interpretations.

È indiscusso che i trattati sui diritti umani sono « strumenti viventi » che devono essere interpretati alla luce delle « condizioni odierne ». Tuttavia, non è chiaro come ciò si concili con il principio di diritto inter-temporale, secondo cui un comportamento di uno Stato non costituisce un fatto illecito internazionale a meno che lo Stato non fosse vincolato dall’obbligo in questione al momento in cui il comportamento è stato posto in essere. Per risolvere tale questione, il contributo esamina come le corti e gli organi di controllo dei trattati sui diritti umani stabiliscono gli effetti temporali delle interpretazioni evolutive.
