Dottrina del diritto e pratica giuridica : un legame in dissolvenza? Relazione introduttiva del Convegno Aristec 2024

This article is the revised text of the introductory report of the ARISTEC (International Association for Historical-Legal and Comparative Research) Conference entitled “Legal Doctrine and Legal Practice: a Fading Bond?”, which was held in Padua in 2024. The aim of the Conference is to propose a dialogue and comparison between representatives of the international academy, not only Roman law, of the judiciary, the legal profession, the notary profession and other relevant institutional entities, thus opening scientific reflection to the understanding of the most lively issues of society and current law. My report, in keeping with the theme of the Conference, examines the relationship between theoretical reflection and the practice of law with reference to the model of Roman iuris prudentia, within which the idea of a science of law that is not substantiated and manifested as ‘merely theoretical knowledge’ but as ‘applied knowledge’ and ‘conditioned by the concreteness of the purpose’ is manifested and realized.
