Ancora a proposito di Gaza

This paper addresses several issues raised by the Israeli military operation "Protective Edge," carried out in 2014 in the Gaza Strip: a) whether the potential activation of the International Criminal Court could, or could not, promote peace. b) whether the Israeli military response is fundamentally in contrast with the prohibition of violations of fundamental human rights as a counter-mesure, and with the principle of non-reciprocity regarding the non-compliance with international humanitarian law (1949 Geneva Conventions; Article 60, paragraph 5, of the Vienna Convention on the Law of Treaties); c) whether Israel remains responsible for the human rights violations committed in the Gaza Strip, regardless of whether the situation can legally be classified as a persistent internationally unlawful occupation.
