Trust e procedure concorsuali

The trustee receives the transfer of an asset or a right (which forms part of a separate estate) and must manage it, as prescribed by equity, in the interest of the beneficiaries. Among the beneficiaries there may be creditors, whose interests can be protected through the trust instrument. At the same time, the establishment of the trust may allow the debtor to overcome a period of financial distress in a less traumatic and damaging way than through formal insolvency proceedings. The paper identifies certain key points in the relationship between trusts and insolvency proceedings as established by Italian case law.

Il trustee riceve il trasferimento di un bene o di un diritto (che forma oggetto di un patrimonio separato) e deve avvalersene, secondo quanto prescrive l’equity, nell’interesse dei beneficiari. Tra i beneficiari possono esservi i creditori, il cui interesse essere tutelato mediante lo strumento del trust, la cui istituzione, nello stesso tempo, può consentire al debitore di superare il momento di crisi con modalità meno traumatiche e pregiudizievoli rispetto alle procedure concorsuali.
