In the international panorama, there is a broad system of principles aimed at protecting the interests of minors, with reference to the New York Convention, which laid the foundations of what would later become the guiding principle of all legislation concerning minors. The transposition and consequent implementation of these principles in the national sphere, with reference to Italy, often encounter discrasies, which are most often due to the heterogeneity given by the jurisprudential interpretation. This contribution proposes to investigate some of these cases and to reflect on the need for interpretative uniformity of principles and Conventions, so as to truly pursue the protection of the best interests of the child.
