La Direttiva sulla tutela penale dell'ambiente e le sfide (irrisolte) dell'armonizzazione sanzionatoria: il caso degli illeciti in materia di rifiuti

The aim of this paper is to investigate the limits of the current European criminal policy on the side of sanction harmonisation. More and more frequently, indeed, the EU adopts in this respect the criterion of a minimum threshold of maximum sanctions. This method, however, does not take into due consideration the peculiarities, and the considerable differences, of the punitive systems of the Member States’ legal systems. Starting, therefore, from the recent Directive on the protection of the environment through criminal law, which broadly adopts this criterion, the paper attempts to reconstruct the possible effects that this may have on the Italian, German and Swedish systems in the field of offences relating to the management and shipment of waste. The analysis aims to highlight the distortions arising from the transposition of the Directive in the systems under consideration and to encourage a rethinking of criminal policy strategies for the harmonisation of sanctions.

Il presente contributo ha l’obiettivo di indagare i limiti dell’attuale politica criminale europea sul versante dell’armonizzazione sanzionatoria. Sempre più di frequente, infatti, l’UE adotta al riguardo il criterio della soglia minima di massimo sanzionatorio. Tale metodo, pero`, non tiene in dovuta considerazione le peculiarità, e le notevoli differenze, dei sistemi punitivi degli ordinamenti degli Stati membri. Partendo, dunque, dalla recente Direttiva sulla tutela penale dell’ambiente, la quale adotta ampiamente tale criterio, il contributo cerca di ricostruire i possibili effetti che questa può provocare sui sistemi italiano, tedesco e svedese nell’ambito dei reati in materia di gestione e spedizione di rifiuti. L’analisi ha l’intento di sottolineare le distorsioni derivanti dal recepimento della Direttiva negli ordinamenti considerati, e di invitare a ripensare la strategia di politica criminale in sede di armonizzazione sanzionatoria.
