La risoluzione del Parlamento europeo in materia di finanziamento privato delle controversie: un modello "responsabile" e sano di regolamentazione

The essay analyses the provisions of the European Parliament Resolution of 13 September 2022 with recommendations to the Commission on Responsible private funding of litigation, titled “Responsible private funding of litigation”. The provisions seem to intercept the problems of third party litigation funding, providing protections to the funding party, before and after contractual arrangements. Given the lack of a legal framework, a provision of a regulatory regime of litigation funding activities and of supervisory authorities as well as the review by courts and administrative authorities are considered opportune.
