Il lavoro analizza il regime delle concessioni demaniali marittime per la costruzione e gestione dei porti turistici di interesse regionale, concentrandosi sull’evoluzione normativa e giurisprudenziale in Italia. Il tema è trattato nel contesto delle finalità turistico-ricreative dei beni demaniali marittimi, evidenziando l’impatto della direttiva Bolkestein e delle sentenze della giustizia amministrativa, che richiedono procedure pubbliche e trasparenti per il rilascio delle concessioni, in linea con il diritto comunitario. Viene criticata la frammentarietà del quadro normativo, che ha causato incertezze e contenziosi giuridici sul rinnovo delle concessioni. Si approfondisce la distinzione tra concessioni turistico-ricreative e concessioni per la nautica da diporto, considerando i meccanismi competitivi già previsti dalla normativa nazionale vigente. Il dpr 509/1997 è citato come norma chiave per regolamentare la costruzione e gestione delle infrastrutture portuali.
