SUL TERMINE DI RIMOZIONE DELLE CAUSE D’INELEGGIBILITÀ IN CASO DI INTERRUZIONE ANTICIPATA DELLA LEGISLATURA REGIONALE

The essay analyse the issue - the subject of the ruling of the Court of Palermo, Civil Section I, 27 May 2024, no. 3323 - concerning the effects of the resignation of the President of the Region and the consequent dissolution of the regional council body (in this case the Sicilian Regional Assembly), on the application of the term (ordinary or abbreviated) for the removal of the causes of ineligibility by candidates to the regional parliament. Resignation and dissolution that in the event of early interruption of the regional legislature occurred, when the ordinary terms provided for by the sector legislation have already expired (180 and 90 days before the completion of a five-year period from the date of the previous regional election) for the removal of the conditions of ineligibility by candidates.

La nota approfondisce la questione - oggetto della sentenza del Tribunale di Palermo Sez. I civ., 27 maggio 2024, n. 3323 - concernente gli effetti delle dimissioni del Presidente della Regione ed il conseguente scioglimento dell’organo consiliare regionale (nel caso di specie l’Assemblea regionale siciliana), sull’applicazione del termine (ordinario o abbreviato) per la rimozione delle cause d’ineleggibilità da parte dei candidati al parlamento regionale. Dimissioni e scioglimento che nel caso di intervenuta interruzione anticipata della legislatura regionale intervenuti, quando siano già spirati i termini ordinari previsti dalla normativa di settore (180 e 90 giorni prima del compimento di un quinquennio dalla data della precedente elezione regionale) per la rimozione delle condizioni di ineleggibilità da parte dei candidati.
