Le perquisizioni on-line : un tema che resta un tabù

In the wake of relevant case-law, the legislator has intervened in order to regulate the use of the s.c. trojan horse for investigative purposes. However, the long-awaited reform referred exclusively to the employment of the tool in carrying out communications interceptions. The contribution aims to identify the problematic points that have remained unresolved, with regard to the multiple and insidious potential of the trojan, especially in the implementation of "online searches". In particular, questions concerning the protection of individual guarantees are addressed also from a comparative perspective.

Sulla scia di rilevanti indicazioni giurisprudenziali, il legislatore è intervenuto sul tema relativo all'uso del captatore informatico a fini investigativi. La riforma, molto attesa, si è tuttavia riferita esclusivamente all'utilizzo dello strumento nello svolgimento di intercettazioni di comunicazioni. Il contributo mira a individuare i numerosi profili problematici rimasti aperti, con riguardo alle molteplici e insidiose potenzialità che l'uso del trojan rivela nell'ottica dell'accertamento penale, specie nella realizzazione di "perquisizioni on-line". Vengono affrontate in particolare, anche in un'ottica comparatistica, le criticità inerenti al rispetto delle garanzie individuali.
