Article 19 grants the courts in each Member State the power to orders in matter involving succession provisional including protective measures that are available pursuant to the law of that State. This includes where the Courts of another Member State have jurisdiction in relation to succession proceedings pursuant to article 4 et seq. ESR. Article 19 therefore ensures that domestic law governing interim relief in each Member State continues to operate.
A presidio dell’effettività della tutela giurisdizionale, l’art. 19 reg. succ. attribuisce ai giudici di ogni Stato membro il potere di pronunciare, in materia successoria, i provvedimenti provvisori e cautelari previsti dalla rispettiva legge nazionale anche quando il giudizio di merito è devoluto ad organi giurisdizionali di altro Stato membro.
