Indipendenza del pubblico ministero e obbligatorietà dell'azione penale nelle proposte di riforma costituzionale della Magistratura

The essay aims to reflect on the proposed constitutional reforms of Title IV of the Constitution. After an excursus of the most relevant profiles of the reform design of the judiciary, for the purpose of a proper understanding of the related issues posed by the reform, both the organization of the offices of the Public Prosecutor's Offices, the management of crime reports with the consequent connections pertaining to the principle of mandatory prosecution were discussed. It was' ultimately verified the compatibility of the reform with the current constitutional position of autonomy and independence of the prosecutor's office.
