Intelligenza artificiale come strumento di governance e nuovi profili di responsabilità degli amministratori

Artificial intelligence (AI), harbinger of new challenges and unprecedented risks, is permeating, inter alia, corporate reality, and particularly the decision-making processes of corporate bodies, with important implications in terms of traceability of the method and sources of information, as well as in terms of liability. In this context, the paper focuses on the analysis of the multiple functional declinations of AI systems in the context of corporate governance dynamics and the associated liability profiles of the directors who make use of them. This is followed, finally, by some brief reflections which, besides touching on the salient points of the work, finally touch upon the regulatory perspective of the phenomenon in question, now known as CorpTech.
