The development of generative artificial intelligence raises a number of questions to the jurist called upon to analyse the phenomenon and its applications. The question proposed last December by the New York Times against OpenAI and Microsoft offers the cue to take a closer look at the copyright issues. In particular, we will examine the allocation of copyright among all parties involved in the creative use of artificial creative use of artificial intelligence, exploring the possibility that through such tools one may infringe the copyright of others.
