L’ABF, gli obblighi informativi concernenti la prescrizione dei BFP e la decisione di non decidere aspettando il TAR Lazio : nota a Collegio ABF di Torino n. 6541 del 26 giugno 2023

With its decision no. 6541 of 26 June 2023, the Turin Banking and Financial Arbitration Board (ABF) dealt with the issue of claims for compensation for failure to repay postal savings bonds, which were time-barred. The ABF declared the appeal inadmissible, due to the lack of finality of the AGCM's decision (PS 11287 - 18.10.2022) qualifying as an unfair commercial practice the professional's failure to provide subscribers with information about the approaching statute of limitations. The author critically examines the arguments developed by the Arbitrator, and particularly the profile pertaining to the issue of competence ratione materiae.
